Name Changes
A former spouse can take back her maiden name during or after a divorce by filing a written notice and following the procedures outlined in Pennsylvania name change law. A similar procedure allows a surviving spouse to resume her former name following the death of her spouse. For other name changes, the law requires a more formal proceeding, including filing a petition with the court and publishing notice to the public and a co-parent. The judge holds a hearing within one to three months of the petition, and anyone who objects to the name change may appear at the hearing and speak against it.
